In compliance with the order dated August 22, 2023, a report is filed on behalf of the District Inspector of Schools (SE), Paschim Bardhaman, the respondent no. 4 herein, let it be kept with the record. The report suggests that disbursement of the retiral benefits of the husband of the petitioner has been delayed due to the failure of the petitioner to take appropriate steps.

The report also suggests that the husband of the petitioner since opted for contributory provident fund cum gratuity, the petitioner is not entitled to family pension.

Mr. Kundu, learned advocate for the petitioner submits that his client is not praying for family pension.

The petitioner during the pendency of the writ petition has submitted relevant papers necessary to disburse the Gratuity with the school authority and those papers have reached to the respondent no.4.

The said respondent is therefore directed to disburse the Gratuirty amount of the deceased teacher to the petitioner along with interest @ 8% per annum from the date on which such amount was payable till the date of payment within six weeks from the date of communication of this order.

W.P.A. 19287 of 2023 is disposed of with the above terms without any order as to costs.
