The petitioner intends to take on lease a space in Howrah Sailen Manna Stadium Market Complex and deposited part payment for the same. Her grievance is that the Corporation is neither accepting the balance payment nor handing over the space in her favour. A representation has been made on behalf of the petitioner which is pending consideration.

Learned advocate representing the Corporation admits receiving the part payment made by the petitioner but submits that the balance payment could not be accepted as the project in question is yet to be finalized.

As it appears that a representation is pending consideration before the Corporation, accordingly, the instant writ petition is disposed of by directing the

Commissioner, Howrah Municipal Corporation or his delegate to consider the representation made on her behalf on 5th May, 2023. A reasoned order shall be passed after giving reasonable opportunity of hearing to the petitioner and by communicating the same. Steps shall be taken in the matter at the earliest but positively within a period of four months from the date of communication of this order.

The writ petition is disposed of.

Learned advocate for the petitioner is directed to forward a copy of the aforesaid representation to the respondents at the time of communicating the order of this Court.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
