The dispute in the present writ petition involves the petitioner being the father and the private respondents being the son and the daughter-in-law.

The petitioner has approached this court as he is unable to stay at his dwelling house at 11, P.K. Mitra Brick

Field Road, Behala, Kolkata- 700054.

The petitioner, being an aged person, be given assistance by the police authorities to enter his house. If, he is unable to enter because of resistance created by the son and the daughter-inlaw, then, in that case, the petitioner would report at Behala P.S. on 29th of September, 2024 at 11.00 am.

The officer-in-charge of the said police station, as he/she deems fit and proper, would engage a personnel to ensure the entrance of the petitioner at the given address and, thereafter, keep a strict vigil so that the petitioner is not harassed at his dwelling house.

The police authorities would also ensure that during his stay at the dwelling house the petitioner is not harassed and humiliated at the said residence.

The petitioner is directed that for future harassment, he would approach the jurisdictional authority, who are responsible for adjudicating the issue relating to senior citizens under the provisions of Maintenance and Welfare of Parents & Senior Citizens Act, 2007.

With the aforesaid observations, WPA 19995 of 2024 is disposed of.
