In the matter of:- Md. Farhan Mrs. Mita Banerjee (Ray) Mr. Barun Kumar Ray .....for the petitioner Mr. Md. Anwar Hossain Mr. M. F. Ahmed Begg .....for the State This is an application seeking an expeditious disposal of a proceeding in which a charge-sheet was submitted under Sections 509, 506 read with Section 34 of the Penal Code.

A supplementary affidavit filed on behalf of the petitioner containing certified copy of the order-sheet is taken on record.

Let a copy of this application be served upon Mr. Md. Anwar Hossain and Mr. M.F. Ahmed Begg, learned counsels, who are present in court today and who ordinarily appear on behalf of the State. Their engagement may be regularised in due course by the competent authority of the State.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the accused in this case. The FIR was lodged by the de facto complainant on 04.07.2017.

After completion of investigation, a charge sheet submitted on 31.08.2018.

Charges were framed on 13.12.2018. Yet, till date the proceeding could not be concluded. Out of 10 witnesses as mentioned in the charge sheet, only 1 witness could be examined. The proceeding has remained pending for no fault of the present petitioner.

Learned counsel for the State submits that there is no inordinate delay caused in concluding the proceeding. Moreover, the petitioners are on bail in connection with the present case.

I have heard the submissions of the learned counsels appearing on behalf of the petitioner and the State and have perused the revision petition. It appears that an inordinate delay has been occasioned in concluding the proceeding.

In view of the above and in the interest of justice, I request the learned trial court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties. With these observations, the revisional application is disposed of Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
