In Re: CAN 2 of 2025 1.

The petitioner has filed the present application being CAN 2 of 2025 praying for recalling of the order dated July 1, 2025 wherein this Court has dismissed the writ petition for default. Consequently, CAN 1 of 2024 was also disposed of filed by the respondents.

The learned counsel for the petitioner submits that when the matter was called, the petitioner could not appear before this Court as the petitioner failed to take note of the case in the cause list. Accordingly, the writ petition was dismissed for default.

Heard the learned counsel for the parties.

This Court finds that the writ petition was dismissed on July 1, 2025 and immediately on July 28, 2025, the petitioner has filed the present application for recalling of the order.

Considering the above, this Court finds that the petitioner has shown sufficient cause for nonappearance of the petitioner before this Court when the matter was called.

Accordingly, the order dated July 1, 2025 is recalled. WPA 19929 of 2024 is restored to its original file. Consequently, CAN 1 of 2024 is also restored. 7.

Accordingly, the application being CAN 2 of 2025 is disposed of In Re: WPA 19929 of 2024 1.

The respondents pray for time to file affidavit-inopposition to the writ application. 2.

The learned counsel for the petitioner prays for time to file affidavit-in-opposition to CAN 1 of 2024. 3.

Let the affidavit-in-opposition be filed within four weeks, reply, if any thereto, be filed within two weeks. 4.

List this matter in the combined monthly list of January, 2026.
