1. This is an application wherein petitioner has prayed for expeditious disposal of the proceeding being Special Case No. 16 of 2019 presently pending before the learned Special Court under NDPS Act at Balurghat.

2. The petitioner's contention is that in the instant case the FIR was lodged on 26th March, 2019, the charge sheet was submitted on 15th November, and thereafter a supplementary charge sheet was also filed on 17th December, 2022 against 18 accused persons. However, since then the charge has not yet been framed. Therefore, he prayed for expeditiously disposal of the case.

3. Since the prayer made on behalf of the petitioner is innocuous and if an order is passed in terms of the prayer made on behalf of the petitioner the Opposite Party will have no cause to prejudice the service of application upon the State is dispensed with.

4. Having heard the learned counsel on behalf of the petitioner I find that the prayer made herein is justified and required to be allowed for the ends of justice.

5. In such situations the instant CRR 3642 of 2025 is hereby disposed of with a direction upon Court below to make charge hearing at the earliest preferably within a period of two months from the date of communication of this order.

6. If the Trial Court finds that some of the accused persons are absconding he will be at liberty to split the case record in respect of the absconding accused persons and to proceed with the charge hearing in according with law. (Dr. Ajoy Kumar Mukherjee, J.)
