In terms of the leave granted on August 31, 2023, a supplementary affidavit to the writ petition is filed on behalf of the petitioner, let it be kept with the record.

The petitioner was a Class IV Staff (Peon) of Badamail Laxmi Pratap High School, District : Dakshin Dinajpur. On superannuation, he has retired from his said service on May 31, 2023. representation for condonation of shortfall of qualifying service to get the benefit of pension is pending before the Principal Secretary, School Education Department, Government of West Bengal, the respondent no.1 herein, the said representation dated September 12, 2023 forms part of the said supplementary affidavit.

The respondent no.1 is directed to consider and dispose of the representation of the

petitioner in accordance with law within a period of three weeks from the date of communication of this order after giving the petitioner or his authorized representatives an opportunity of hearing.

WPA 19302 of 2023 is, thus disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
