Learned advocate appearing for the petitioner submits that the petitioner is in custody for nine months and initially he was granted bail, but subsequently he has been taken into custody on the grounds that he was absent on few occasions before the learned Trial Court. Petitioner prays for bail on any stringent condition.
Learned advocate for the State has submitted a report which reflects that case is of the year 2013. Petitioner has been absconding and as such, till date charge could not be framed. As such, the petitioner should not be released on bail Records reflect that there were recoveries of 784 bottles of Phensedyl in the instant case and other accused
persons are absconding. Learned Trial Court, as such, is directed to split up the trial of the case.
At this stage, the prayer for bail of the petitioner is rejected.
Petitioner will renew his prayer for bail after the stage for consideration of charges is over.
Report submitted by the learned advocate appearing for the State be kept with the record.
The application for bail, being CRM (NDPS) 1056 of 2025, is, thus, dismissed.
