Affidavit of service filed by the petitioners is taken on record.

The petitioners are Assistant Teachers of different District Primary School Councils. They seek for grant of 'A' category scale of pay.

It is primarily found that the cause of action of the petitioners are different and distinct.

Accordingly, the prayer of petitioner no.1 is taken up for consideration.

The petitioner no.1 has been granted 'A' category scale of pay from 1st July, 2019. The petitioner no.1 claims 'A' category scale of pay from the date of his joining. On 15th May, 2025, petitioner no.1 made a representation for grant of 'A' category scale of pay

from the date of his joining. However, the same is still pending consideration. Hence, this writ petition. 6.

Mr.

Shuvro Prokash Lahiri, learned Advocate appearing for the petitioner no.1 submits that the matter be relegated to the appropriate authority for due consideration.

Mr. Ratul Biswas, learned Advocate appearing for the West Bengal Board of Primary Education concedes to the said submission advanced on behalf of petitioner no.1.

Accordingly, respondent No.2, Commissioner of School Education, Government of West Bengal is directed to consider the representation of the petitioners dated 15th May, 2025 (Annexure P-6) and dispose of the same by passing a reasoned order in accordance with law upon notice to the petitioner no.1 within a period of 12 weeks from date of communication of this order.

It is left open to the other petitioners to take appropriate steps by filing fresh writ petitions in accordance with law.

Learned advocate for the petitioner no.1 is directed to communicate this order to the respondent No.2, the Commissioner of School Education, Government of West Bengal, for necessary compliance.

With the above direction, the writ petition being WPA 19000 of 2025 stands disposed of.

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

Interim order, if any, stands vacated.

All connected applications, if any, stand disposed of. 15.

There shall be no order as to costs.

16.

All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

17.

Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
