This instant revisional application is directed against order no. 14 dated 8th August 2025 passed by the Additional District and Sessions Judge, 7th Court, North 24 Parganas, in SC case no. 102 of 2025.

By the impugned order the Learned Trial Court rejected the application filed on behalf of the petitioners seeking discharge from the case.

It is submitted on behalf of the learned advocate appearing for the petitioner that the Learned Trial Court, upon consideration of the materials in the case diary, was of the view that Section 413 of the Bhartiya Nyaya Sanhita (BNS) was applicable against all the accused persons in the said trial and on such finding the Learned Trial Judge proceeded to fix up the case for framing of charge.

It is informed that the SC case no. 102 of 2025 has been fixed today for consideration of charge.;

It is specifically held by the Learned Trial Court that for consideration of charge, nothing beyond the report under Section 173 of the BNSS, 2023 could be considered. The Learned Trial

Court, upon consideration of the materials in the case diary was of the opinion that there were materials in the case diary to proceed against the petitioners. He did not find anything to discharge the petitioners.

In such view of the case, I find no merits in the revisional application and as such the same is dismissed. 7.
