Since the innocuous prayer of the petitioner is for expeditious disposal of GR Case No.1402 of 2016 pending before the learned Judicial Magistrate, 6th Court, Bankura the matter may be disposed of without service of notice upon the opposite party.

The opposite party shall not be prejudiced by an order directing expeditious disposal of the case. It appears that in an earlier revisional application filed by the petitioner being CRR 3003 of 2023 this Court by an order passed on August 21, 2023 directed the learned trial court to fix one date in each and every month from the next date so fixed so that the trial of the case could be concluded at the earliest, preferably by 31st December, 2024.

The operative portion of the order is set out: "Having regard to the plight expressed by the petitioner for facing the agony of criminal case for the last 7 years, I direct that the trial court would fix one date in each and every month from the next date so

fixed so that the trial of the case can be concluded at the earliest, preferably by 31st December, 2024. No unnecessary adjournment should be granted to the parties.

Public Prosecutor conducting the case would make available all the necessary documents, statements, materials and exhibits on the date on which the witness would appear before the court. All stakeholders must cooperate with the court to complete the trial within a reasonable period of time." The said order also records that 7 out of 12 charge sheeted witnesses were examined till then.

It appears that only one more witness was examined after the said order.

The learned Trial Court is directed to dispose of the case within six months from the next date of hearing fixed before him peremptorily, without granting any unnecessary adjournment to either of the parties, in accordance with law.

The revisional application being CRR 3333 of 2024 is disposed of.
