Report submitted by the learned advocate appearing for the State be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.

Pursuant to the earlier order dated 26.09.2024, a report has been submitted by the State which reflects that field visit and local enquiry and a report from the BL & LRO, Udaynarayanpur has not been received from the concerned office. The primary allegation of the petitioner is that her property was being encroached.

The learned advocate for the State submits that there are issues relating to drainage, construction of wall and blockage which are absolutely village disputes particularly relating to cultivation.

Having considered that the police authorities in their report have expressed that they are keeping a strict vigil over the area so that no breach of peace takes place, I direct that a copy of the report

prepared by the BL & LRO, Udaynarayanpur be handed over to the petitioner.

In case if an inspection is done, then the same be done in presence of all the parties including the present petitioner or her husband or any person authorised by her. A copy of such report be sent to the petitioner. If the petitioner is aggrieved by the findings in the report, the petitioner would be at liberty to canvass such issue at the appropriate forum/jurisdiction.

So far as issues relating to police inaction is concerned, the police authorities by its report have already stated that they have been keeping a strict vigil so that no untoward incident takes place. With the aforesaid observations, the writ petition being WPA 19981 of 2024 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
