1. The petitioner is aggrieved by the action on the part of the respondent no. 5 in not permitting the petitioner to take physical possession of the property purchased by the petitioner on auction under the provisions of the SARFAESI Act allegedly on the ground that there are maintenance dues pending from the previous owner.

2. Upon hearing the submission of the petitioner it appears that the dispute in question is an absolute private dispute in between the petitioner and the Apartment Owners' Association. There is no public element involved in the instant writ petition.

3. In the event the petitioner has any grievance against the Apartment Owners' Association, it will open for the petitioner to take appropriate remedy before the competent forum in accordance with law.

4. The writ petition stands disposed of.

5. Urgent certified photocopy of this order, if applied for, be supplied to the parties on compliance of usual legal formalities.
