He will retire on superannuation with effect from 31.01.2023. From a simple calculation it appears that the petitioner is short of two months and two days qualifying service for getting pension.

I direct the Commissioner of School Education to consider the matter as there is a provision in the death-cum-retirement benefit scheme of the Government of West Bengal that the deficiency in the length of service can be considered by the Government for giving such teachers' benefit of pension. Such decision is to be taken by the Commissioner of School Education by eight weeks from the date of communication of this order and if necessary, after giving an opportunity of hearing to

the petitioner to communicate the reasoned order to the petitioner by two weeks after the date of hearing. With this observation and direction, this writ application is disposed of.

Affidavit of service filed in court today be kept on record.
