The petitioners complain that there has been interference with the cultivation in their land and, to that effect, the private respondents have been trying to destroy the harvest. When the petitioners resisted the same, they were subjected to threat, assault and abuse at the behest of the private respondents.

In spite of informing the same to the police

authorities, no action has been taken by the police authorities.

Since none appears on behalf of the State, Ms. Neelam Singh, learned advocate, who ordinarily appears for the State, is directed to represent the State.

Her appearance may be regularized by the concerned authorities.

As more than one and half years have passed in the meantime since the representation was made, the petitioners, if they face the same inconveniences, they would file a fresh representation with the police authorities who would ensure that there is no breach of the peace and/or tranquility taking place as also any further untoward incident relating to cultivation taking place until and unless there is a specific order from the civil court being passed in favour of the private respondents.

With the aforesaid observations,

WPA 19322 of 2023 is disposed of.

Pending application(s), if any, is also disposed of.
