No. 29 KAUSHIK REJECTED C.R.M.(A) 4159 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Teherpur Police Station Case No. 212 of 2019 dated 12.09.2019 under Sections 447/325/308/506/34 of the Indian Penal Code, 1860.

And In Re : Rabi Majhi ...... petitioner Ms. Sananda Bhattacharya ....for the petitioner Mr. Shiladitya Banerjee ....for the State The police case is of September 12, 2019.

The petitioner is absconding since then.

There is a claim for parity with the other co-accused, who was enlarged on anticipatory bail on December 19, 2019 in CRM 11970 of 2019.

We are unable to accept the claim for parity in view of the long absconsion of the petitioner.

In such circumstances, we are unable to grant anticipatory bail to the petitioner.

In such circumstances, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 4159 of 2022 is dismissed.
