17.11.2025 Item No.46 BR CO 2934 of 2024 Manju Kundu -vsDudh Kumar Manna and another Ms. Dipika Basu, Mr. S.Chakraborty, Ms. Bolivia Roy The civil revision has been preferred praying for direction that the Survey Commissioner appointed by the trial Court vide an order dated 1.4.2022 should submit his report at the earliest.

Subsequent prayers by the petitioner to change the learned Commissioner considering the delay has been rejected by the trial Court.

Considering the nature of relief prayed for, service in this case dispensed with and on considering the delay in filing of the Survey Commissioner's report which is pending for more than 3 years the civil revision is disposed of with the direction that the trial Court being the learned Civil Judge (Junior Division ), 6th Court , Howrah shall ensure that the report

is filed by the Survey Commissioner within 60 days from the date of this order.

Let a copy of this order be communicated to the learned District Judge, Howrah who shall personally look into the matter considering the long delay and pass necessary directions upon the Court concerned to ensure compliance of this order.

CO 2934 of 2024 stands disposed of.

Let a copy of this order be sent to the trial Court at once.
