Criminal Revisional Jurisdiction 22-02-2024 Subha Item no.06 Ct no.34 CRR 2558 of 2021 Salil Ghosh -versus- The State of West Bengal Mr. Sabyasachi Banerjee Ms. Mrinal Palna ....for the petitioner.

The present revisional application has been preferred challenging the order dated 24-09-2021 passed by the learned Judge, Special(CBI) court no.1, Calcutta in connection with the refusal of the application for discharge.

I have considered the reasons assigned by the learned Special Judge. The learned special court has taken into account all the documents, which were relied upon by the prosecution. Taking into account the submissions so advanced on behalf of the learned advocate for the petitioner along with the relevant materials relied upon by the prosecution, the court opined that the accused entered into a conspiracy to deceive the railways.

Having considered the reasons so assigned by the learned special court and the factum that at the stage of consideration of charges, the court has to weigh whether the documents relied upon by the prosecution gives rise to some suspicion or grave suspicion, I am of the view that the case gives rise to a grave suspicion for the trial of the case to continue.

Accordingly, the order passed by the learned Special

Judge(CBI) court no.1, Bichar Bhawan, Calcutta in connection with Special(CBI) Case No. 4 of 2016 is not interfered with. Petitioner would be at liberty to take up the issues in course of the trial. With the aforesaid observations, the present revisional application being CRR 2558 of 2021 is disposed of. Pending connected applications, if any, are consequently disposed of.
