Petitioner complains that she is unable to enter the matrimonial home and requires an alternate accommodation. To that effect records reflect that information has already been sent to the police authorities but a proceeding under the relevant provisions of PWDV Act is pending before the learned Judicial Magistrate, 10th Court, Alipore.

State has submitted a report. Report reflects that Parnashree Police Station case no.

700/24 and Parnashree Police Station case no.

869/24 were registered for investigation. Police authorities are well aware regarding the dispute as also the factum of the proceedings being CC 1344 of 2025 pending before the learned Judicial Magistrate, 10th Court, Alipore. In case any direction is passed by the learned Judicial Magistrate, 10th Court, Alipore, police authorities

would in such circumstances provide aid to the petitioner.

Learned Chief Judicial Magistrate is directed that in case the Court of the learned Judicial Magistrate in seisin of CC 1344 of 2025 is vacant, the learned C.J.M. will assign the case at least for consideration of the interim relief to any learned Judicial Magistrate of his choice or the same be considered by him.

With the aforesaid observations WPA 19540 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
