Jyotsna Mondal (Sarkar) Mr. Pinaki Dhole ... ... for the petitioner Learned advocate appearing for the petitioner submits that the petitioner has preferred an application for incorporating certain amendments in the written objection which includes materials which were not available at the time when the application for interim maintenance was heard and disposed of/allowed by the learned Chief Judicial Magistrate, Malda in connection with Case No.63 M/2017. The said prayer is still pending before the learned Chief Judicial Magistrate, Malda. According to the learned advocate appearing for the petitioner such prayer is pending since 2019 but till date the same has not been considered by the learned Court. Having regard to the prayer advanced by the petitioner, I direct that the trial Court would consider the petitioner's application which is pending for a considerable period of time on the next date so fixed or within a month thereafter. Learned Magistrate thereafter would proceed in accordance with law.

With the aforesaid observations, CRR 3224 of 2022 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
