The Registrar, University of Calcutta has passed a reasoned order on February 11, 2022 allegedly in compliance of the order passed by this Court on July 13, 2021.

By the said order the prayer of the petitioner for being appointed on compassionate ground has been rejected on the ground that the University of Calcutta being State aided University does not have any scheme for appointment on compassionate ground.

Learned advocate for the petitioner submits that, according to the First Statutes of the University of Calcutta there is already a provision for providing

appointment on compassionate ground to the heir of the deceased.

The legality of the order passed by the Registrar of the University cannot be gone into in the contempt application.

Accordingly, leave is granted to the petitioner to challenge the order passed by the Registrar of the University before the appropriate forum in accordance with law, if so advised.

The contempt application stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
