Syamal ...... for the petitioner Mr. S Bardhan Mr. P C Majhi ...... for the State Petitioner renews his prayer for bail and submits that there is slow progress in the matter before the trial court. Learned lawyer for the State opposes the prayer for anticipatory bail.

Having considered the materials in the case diary disclosing prima facie involvement of the petitioner in the alleged joint possession of 1800 bottles of phensedyl containing codeine mixture above commercial quantity and in the light of the statutory restrictions under section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail is rejected. Trial court is requested to consider the issue of framing of charge at the earliest preferably within three months from the next date fixed and thereafter to take the matter to its logical conclusion without granting unnecessary adjournments to the parties.
