Earlier by an order dated 21.08.2023, a report was called for from Baguiati Police Station Case No. 228 of 2020 dated 20.07.2020 under Sections 498A/406 of the Indian Penal Code. The report dated 29.08.2023 submitted by Mr. Imran Ali, learned advocate appearing for the State be kept on record.

The case arose out of matrimonial discord. The statement reflects that a communication has also been made to the investigating officer and the investigating officer has owed the responsibility of the statement that the opposite party no.1/de facto complainant is unwilling to pursue the present case being Baguiati Police Station Case No. 228 of 2020 dated 20.07.2020. Having regard to the changed circumstances, I am of the opinion that further continuance of G.R. Case No.1666/2020 arising out of Baguiati Police Station Case No. 228 of 2020 dated 20.07.2020 which was registered for a matrimonial discord and wherein chargesheet was submitted under Sections 498A/406 of the Indian Penal Code is unwarranted and the same as such is quashed.

Accordingly, the revisional application being CRR 2999 of 2023 is allowed.

Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
