Goutam Roy & ORS v. State Of West Bengal
C.R.R. No.2618 of 2012 (Via Video Conference) D/L 59.
September 14, 2021 Bpg.
In Re: An application under Section 401 read with Section 482 of the Code of Criminal Procedure.
Sri Goutam Roy & Ors.
Versus
The State of West Bengal Mr. Arijit Ganguly, Mr. Saryati Datta.
...for the State.
The revisional application was preferred challenging the proceedings relating to Purulia (T) Police Station Case No.01 of 2012 dated 06.01.2012.
The petitioners approached this Court at the stage when the investigation of the case was progressing. As none appeared for the State, Mr. Saryati Datta, learned advocate, is directed to represent the State. His appointment may be regularised by the concerned authorities. Records of the revisional application reflect that on 24.07.2012 and 7.8.2012 when the revisional application appeared before a co-ordinate Bench, none represented to present the revisional application and, as such, the same till date has not been admitted.
Having regard to the fact that the contentions advanced in the revisional application are issues of fact which cannot be adjudicated at this stage after nine years when the present stage of the proceedings have not been apprised to this Court, I am of the
view that no interference is called for.
Accordingly, CRR 2618 of 2012 is dismissed.
Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
