In Re: An application under Section 482 of the Code of Criminal Procedure, 1973.

Dipak Kumar Shaw @ Deepak Kumar Shaw

Versus

State of West Bengal Mr. Imran Ali, Ms. Debjani Sahu.

...for the State.

The revisional application was preferred challenging the proceedings relating to Tala Police Station Case No.58 of 2011 dated 03.08.2011.

The records of this revisional application reflect that at no point of time, this revisional application was pursued before this Court and till date, the same has not been admitted. The report submitted by the Officer-in-Charge of Tala Police Station reflects that there was no execution return of the warrant of arrest in respect of the accused persons. Let the report be kept with the record.

Learned Magistrate is directed to take steps in this matter on the next date so fixed, that is, on 26.05.2022 as a public servant has been harassed while he was on duty. So far as the merits of the revisional application is concerned, on perusal of the First Information Report, charge-sheet, the statement of the witnesses, I am of the view that no interference Is called for at this stage.

Accordingly, CRR 2621 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
