CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE ( Via Video Conference ) CRR 2752 of 2008 In Re : Sk. Lutfar Rahaman ........Petitioner.

In the matter of : An application under Section 401 read with Section 482 of the Code of Criminal Procedure, 1973. None appears on behalf of the petitioner as well as the opposite parties.

The present revisional application has been preferred in respect of a proceeding under Section 125 of the Code of Criminal Procedure, Purba Medinipore wherein the learned C. J. M, Purba Medinipore was pleased to allow an interim maintenance of Rs.500/- per month. The husband being aggrieved preferred a revisional application before this court challenging the said order dated 04.06.2008.

I have perused the reasons assigned by the learned Magistrate while allowing interim maintenance. I am of the considered view that the quantum so imposed was by way of an interim measure pending the final disposal of the

application under Section 125 of the Code of Criminal Procedure.

Having regard to the cost index and the socioeconomic status of the parties, I am of the view that the same do not require any interference.

As such, the revisional application is dismissed. Interim order, if any, is hereby vacated.

If there are any arrears due, the learned Magistrate would consider the same if an application to that effect is filed by the wife/opposite party no1.

CRR 2752 of 2008 is, hereby, disposed of. All connected applications, if any, are disposed of. Department is directed to communicate this order to the learned Chief Judicial Magistrate, Purba Medinipore.
