The prime contention of the petitioner is that in a complaint case filed by the petitioner under Section 138 of the Negotiable Instruments Act, although a warrant of arrest was issued to the private respondent who is a resident of Maharastra, the same was not executed.

Learned counsel appearing on behalf of the State submits that it is for the petitioner to ventilate such grievance before the learned Trial Court and pray for an appropriate relief. The writ petition is disposed of with the liberty granted to the petitioner to pray for appropriate relief before the learned Trial Court in respect of the alleged non-execution of warrant of arrest.
