Mr. Rana Mukherjee ... for the State This is an application wherein petitioners have sought for a direction upon the court below for expeditious disposal of Criminal Case being G.R. No. 1461 of 2006 arising out of Lake Police Station Case No. 115 of 2006.

Learned counsel appearing on behalf of the petitioners submits that said proceeding is pending for more than 18 years before the Court below. Though the State is represented but the other opposite parties are not represented.

It appears that the prayer made by the petitioners is very innocuous and if the present application is disposed of in terms of the prayer made in the application, neither party will have a cause to prejudice.

Having considered the facts and circumstances of the case and long pendency of the matter I find that the prayer made by the petitioners is justified.

CRR 2816 of 2016 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the Criminal Case being G.R. No. 1461 of 2006 arising out of Lake Police Station Case No. 115 of 2006 pending before the learned IX Judicial Magistrate, Alipore and he is further directed to make every endeavour for day to day trial, if possible, and to conclude the entire proceeding preferably within a period of six months from the date of communication of this order, without granting any unnecessary adjournment to either of the parties. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
