The petitioner is the wife of the employee late Ramabatar Mahato who was employed under the 3rd respondent and superannuated on January 22, 2011 after serving for more than forty years. No gratuity has been paid to him. The petitioner being the nominee, legal heir and successor of the employee, filed an application in Form 'N' before the 2nd respondent on April 8, 2016 which was registered as Case no. G48/16. The said application is still pending before the authority. The petitioner prays for a direction upon the authority to consider and dispose of the said application at the earliest.

Having considered the submissions made on behalf of the parties and material on record the writ petition is disposed of directing the 2nd respondent to

consider and dispose of the application filed by the petitioner dated April 8, 2016 within a period of three months from the date of communication of this order after affording reasonable opportunity of hearing to all the interested parties including the petitioner, in accordance with law.

WPA 20466 of 2021 is disposed of. However, there shall be no order as to costs.

Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.
