It is submitted that the respondent authorities are arbitrarily and whimsically providing such electricity connection to third parties from the existing pole, which is located on the land belonging to the petitioner.
In such circumstances, the petitioner prays for an electricity connection be provided from an alternative plot of land or through an underground connection.
On behalf of the private respondent, it is submitted that the petitioner is a habitual mischief maker and is constantly objecting to any person obtaining a separate electricity connection.
On behalf of the WBSEDCL, it is also submitted that the petitioner is wrongfully and illegally objecting to any electricity connection being provided to any third party.
Having heard the submissions made on behalf of the parties and in view of The Works of Licensees Rules, 2006, the matter is remanded to the concerned jurisdictional District Magistrate, Purba Medinipur having jurisdiction to adjudicate upon the subject matter and to determine whether it is possible to have an alternative arrangement in so far as providing of electricity connection to third parties seeking a separate connection are concerned.
It is made clear that there has been no adjudication on the merits of the case and all questions are left open to decide the matter strictly in accordance with law.
The above exercise shall be completed within a period of four weeks from the date of communication of this order and after giving notice to all the interested parties.
With the above directions, WPA 19177 of 2025 stands disposed of.
