Petitioner is aggrieved by the fact that there is a status quo order passed in T.S. 51 of 2018 which is being violated by the private respondents and in spite of informing the police authorities no steps are being taken. Petitioner further complains that in spite of informing the police authorities, although a criminal case has been registered being Pukuria PS case no. 161/2025 dated 02.04.2025 but no effective steps till date has been taken, as such the petitioner was compelled to approached this Court.

Learned advocate for the State has submitted a report. Report also reflects that relating to the aforesaid case pending before the jurisdictional Court. Reference has been made in respect of the order passed by the learned Civil Judge (Senior Division), Chanchal, Malda. Police authorities have also drawn up proceedings under Section 126 of the BNSS.

Having considered the steps taken by the police authorities, I am of the view that the same were in consonance with the provisions of law. If there are violence in respect of an order passed by the Civil Court, petitioner would approach the Civil Court for breach of such order. Police authorities would act, in case the Civil Court passes any directions upon them. However, having regard to the strained relationship existing between the petitioner and the private respondents, police authorities would oversee that there is no violation of the law and order.

With the aforesaid observations WPA 19526 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
