1. The petitioner is granted liberty to rectify the cause title regarding the Police Station Case.

2. Learned advocate for the petitioner and the learned advocate for the State of West Bengal are present.

3. Heard the learned advocates for the parties.

4. Learned advocate for the petitioner submits that the petitioner is falsely implicated in the instant case. It is further submitted that the petitioner was not named in the FIR and was implicated subsequently.

5. Learned advocate for the petitioner draws attention to the statement made in the supplementary affidavit that the petitioner on the date of incident was at Kalna Court for the purpose of deposition.

6. Learned advocate appearing for the State of West Bengal draws the attention to the statement of victim and medical injury report.

7. Upon perusal of the materials in the case diary and upon hearing the learned advocates although involvement of the petitioner cannot be ruled out at this stage, but considering the nature of allegation, the stage of investigation and the fact that some of the co-accused are on bail as this Court is of the view that there is no reasonable ground to abscond the petitioner, the petitioner should be granted anticipatory bail.

8. I, therefore, allow the application for anticipatory bail made by the petitioner.

9. In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each, with two sureties of like amount, one of whom must be local subject to the satisfaction of the Arresting Officer and on conditions that the petitioner shall meet the I.O as and when required and shall not do any act prejudicial to any investigation. 10.

Accordingly, the application for anticipatory bail is allowed. 11.
