Not only is the respondents a private enterprise, the petitioner also seeks relief in terms of a loan-cum-hypothecation agreement which is purely of a private nature between the petitioner and the respondents. It is also revealed from the submission of learned counsel appearing for the parties that the arbitrator has passed an award in 2020 with reference to the dispute.

WPA 19749 of 2022 is accordingly dismissed without any order as to costs.
