Petitioners assail the order dated 24th December, 2021 passed by learned Civil Judge (Junior Division), Additional Court, Nadia at Krishnanagar, in Title Suit No. 33 of 2010 rejecting the application filed by the petitioners/judgment debtor dated 22nd March, 2021. Admittedly, a decree was passed after a contested hearing.

In the execution proceeding, the petitioners challenged the pecuniary jurisdiction of the Court, alleging that instead of valuation of the land, there has been suit valuation.

The point so raised, could not be raised, at the time of trial of the suit.

It is for the first time raised during the execution proceeding.

Upon perusal of the impugned order, it appears that there is no reason to interfere with the impugned order, as it is supported by sufficient reasons. The revisional applications stands disposed of. (Subhasis Dasgupta, J)
