Swarup Kumar Das v. State Of West Bengal & ORS
16.08.2022 Court No.13 Item No.10 AP WPA 16519 of 2011 Swarup Kumar Das Vs.
The State of West Bengal and Ors.
Mr. Ekramul Bari Ms. Tanuja Basak Mr. Sk. Imtiaj Uddin ... For the Petitioner.
Mr. Sudipto Panda Ms. Munmun Tewary ... For the State.
The petitioner is aggrieved by the order dated 1st September 2011 passed by the District Inspector of Schools (SE), Purba Medinipur refusing to approve a panel for the recruitment to the post of Laboratory Attendant at Bajitpur Saradamani Balika Vidyalaya, Purba Medinipur.
The District Inspector of Schools (SE) found a large number of infirmities in the recruitment process including postponement of interview and counter signing of call letters to candidates not having been produced. Prima facie there is violation of recruitment Rules of 2005. This Court therefore finds no irregularities with the findings of the District Inspector of Schools. The District Inspector of Schools was justified in refusing to approve the panel in question.
In that view of the matter, no relief can be granted to the petitioner.
The writ petition is therefore dismissed.
There shall be no order as to costs.
Interim orders, if any, shall also stand vacated. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
