Heard learned counsels for the parties.

The petitioner is the hapless mother of Jainul Akhtar, who was an employee under the 3rd respondent and died in harness on 28th January, 2018. The petitioner being the nominee of her deceased son approached the management/respondent No.3 for payment of gratuity but to no effect.

The petitioner subsequently filed an application before the 2nd respondent for payment of gratuity in her favour which was registered as Gratuity Case No.42/20/DLC/HOW, but no further step has been taken by the authority in the matter till date.

The petitioner prays for a direction upon the authority to consider the case at the earliest.

Upon consideration of the submissions made on behalf of the parties and material on record, the writ petition is disposed of by directing the 2nd respondent to conclude the proceeding pending before it on merits within a period of four months from the date of communication of this order, after giving reasonable opportunity of hearing to all the interested parties including the petitioner, in accordance with law.

With the above observations and directions this writ petition being WPA 20488 of 2021 is disposed of. However, there shall be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
