The tribunal application filed a decade before is still lingering in the docket of the Tribunal and could not be disposed of.

It is submitted by the learned Advocate for the petitioners that the Tribunal is granting adjournments mechanically or merely on the prayer of any of the appearing Counsels without showing any alacrity to the issues involved in the said proceeding; thereby impeding early disposal of the same. The next date is fixed on 5th December, 2012.

It is uniformly submitted that the said tribunal application is otherwise ready for final disposal and all the Counsels appearing for the respective parties have assured this Court that they would co-operate with the Tribunal for disposal of the said proceeding. In view of the above, the Tribunal is requested to take up the said matter on the date already fixed, i.e. December 5, 2022 and endeavour shall be shown to dispose of the same within two months therefrom after affording an opportunity of hearing to all the parties

and by recording proper reasons in accordance with law.

Nothing observed hereinbefore shall have any impact on the merit of the said application, which would be decided independently. However, we are assured that the parties shall not seek unnecessary adjournment before the Tribunal unless necessitated by any unforeseen and unavoidable circumstances. The writ petition is thus disposed of.

There will be no order as to costs.
