Alimuddin Tahar And ANR. v. State Of West Bengal
AD 43 September 18, 2025 Ct. 28 SG CRM(A) 3008 of 2025 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Chanchal P.S. Case No.720 of 2025 dated 09.06.2025 under Sections 126(2)/118(2)/109/351(2)/3(5) of the BNS, 2023.
And In the matter of:
Alimuddin Tahar and another ... petitioners Mr. Parvej Alam Mr. Sayantan Adhya Md. Nadeem ... for the petitioners Mr. Imran Ali Mr. Tirthankar Dhali ... for the State Learned counsel for the petitioners submits that the petitioner No.1 has already been arrested. As such, the application for anticipatory bail is not pressed so far as the petitioner No.1 is concerned. In fact, the petitioner No.1 is the principal accused. Some other co-accused were granted anticipatory bail by the Sessions Court.
Learned counsel for the State strongly opposes the prayer for anticipatory bail and submits that two victims were stabbed, one in the abdomen. They received serious injury and had to be treated medically.
In view of the above submissions, the application for anticipatory bail is dismissed as not pressed so far as the petitioner No.1 is concerned.
Considering the incriminating materials available in the case diary, including the medical papers and the statements of witnesses, I do not consider this to be a fit case for granting anticipatory bail of the petitioner No.2. The application for anticipatory bail is also rejected so far as the petitioner No.2 is concerned.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
