...for the State Mr. Susanta Pal ...for the respondent controlling authority It is submitted on behalf of the petitioner that the petitioner was an employee with the 3rd respondent and superannuated on 1st January, 2009. The petitioner approached the employer on several occasions for payment of gratuity due to him and also filed an application in Form I before the authority but to no effect. The petitioner subsequently filed an application before the 2nd respondent in Form 'N' which was registered as Gratuity Case No. G-73/15/DLC/HOW.

The said case yet to be disposed of. The petitioner prays for a direction upon the 2nd respondent to dispose of the gratuity case pending before it at the earliest. None appears on behalf of the 3rd respondent.

Upon consideration of the submissions made on behalf of the parties, the matter is disposed of by directing the 2nd respondent to consider and dispose of the Gratuity Case being No. G-73/15/DLC/HOW was pending before it within a period of four months from the date of communication of this order in accordance with law after giving reasonable opportunity of hearing to all the interested parties including the petitioner and the private respondent.

With the above observations and directions this writ petition being WPA 20495 of 2021 is disposed of. However, there shall be no order as to costs. Since no affidavit has been invited, the allegations contained in the writ petition shall be deemed not to have been admitted.
