It is submitted by the counsel for the appellant that Title Suit No.996 of 2022 itself has been dismissed by the 12th Bench of the City Civil Court at Calcutta on 8th August, 2023.

In that view of the matter, the appeal arising out of an interlocutory order in the suit has become infructuous. 3.

Hence, FMAT (ARBAWARD) 47 of 2022 shall stand dismissed as infructuous.
