Guha Biswas ....for the State The petitioner prays for a direction upon the authority to consider his application submitted before the authority on 18.08.2022 for replacing a higher model vehicle in place of the present vehicle plying in the route in terms of Section 83 of the Motor Vehicles Act, 1988. It is submitted on behalf of the State-respondents that the 4th respondent be directed to consider the representation in accordance with law.

In view of the above, the writ petition is disposed of directing the 4th respondent to consider and dispose of the application of the petitioner within a period of eight weeks from the date of communication of this order, after giving reasonable opportunity of hearing to the petitioner, in accordance with law.

With the above observations and directions this writ petition is disposed of.

There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.
