The report in the form of an affidavit filed by the respondent nos. 2, 3, 4 and 5 is taken on record. A copy of the report has already been served upon the petitioner.

On a perusal of the report, it appears that the second Career Advancement Scheme (in short, CAS) has already been paid to the petitioner on 1st November, 2005.

The petitioner is unable to demonstrate anything contrary to what has been stated by WBTC in the report. The petitioner is not, therefor, entitled to any relief, as claimed in the writ petition. The writ petition is accordingly disposed of without any order as to costs.

Since I have not called for any affidavits, save and except a report in the form of an affidavit, the allegations contained in the writ petition or in the report in the form of an affidavit are deemed to have not been admitted by the parties.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
