Banerjee) Mr. Amar Singh ...for the petitioners This application under Article 227 of the Constitution of India is at the instance of the defendants praying for a direction upon the learned Civil Judge (Jr. Division), 1st Court at Barasat to dispose of the application under Order 7 Rule 11(d) of the Civil Procedure Code, filed in Title Suit No. 1143 of 2023, expeditiously.

Learned advocate appearing for the petitioners submits that the date of hearing of the said application has been fixed on April 29, 2026. Learned advocate appearing for the petitioners further submits that the petitioners have filed an application for preponing the next date of hearing. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioners shall be

obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing them before the learned trial judge.

In the light of the submission made by the learned advocate appearing for the petitioners CO 3055 of 2025 stands disposed of by requesting the learned Civil Judge (Jr. Division), 1st Court at Barasat to consider the application for preponing the date of hearing filed by the petitioners and thereafter take up the hearing of the application under Order 7 Rule 11(d) of the Civil Procedure Code, if the same is otherwise ready for hearing and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
