Mr. Bhaskar Nandi ..for the petitioner Mr. Pantu Deb Roy Mr. Jaladhi Das ..for the State The petitioner submitted an application for an Inter-State Stage Carriage Permit for the route from "Kolkata Central Bus Terminus (KCBT) at Santragachi to Jaipur, extended up to Bari via Laxmannath," pursuant to an Inter-State Reciprocal Transport Agreement entered into between the States of West Bengal and Odisha.

The State Transport Authority, West Bengal, by an order dated March 25, 2025, declined the petitioner's request on the ground that there was no existing vacancy on the specified route.

This Court directed the State to file a report in response to the allegations raised in this writ petition. Mr. Pantu Deb Roy, learned Advocate representing the State Transport Authority, West Bengal, submits that, contrary to the earlier order, a

vacancy does exist against which the petitioner's application may be considered alongside other pending applications. He further states that appropriate steps will be taken to fill the said vacancy in accordance with the law.

In view of the stand taken by the State Transport Authority, West Bengal before this Court, I find no justification to keep this writ petition pending. Accordingly, the communication dated March 25, 2025, appearing at page 22 of the writ petition, is set aside. I further direct the State Transport Authority, West Bengal, to consider the petitioner's application along with other applications, if any, in accordance with law, within a period of three months from the date of communication of this order.

Accordingly, WPA 19351 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
