The writ application has been preferred challenging order dated 11th December, 2024 passed under Section 7A of the EPF & MP Act, 1952 and the recovery notice dated 4th August, 2025 wherein the authority proposed to recover an amount of Rs. 40,57,388/-.

Learned counsel for the petitioner has filed a document showing that an appeal has been preferred against the order under challenge in the present writ application before the Provident Funds Appellate Tribunal on 01.08.2025.

It is submitted by the learned counsel for the petitioner that as the Tribunal is not functioning on regular basis, the petitioner has filed the writ application.

Learned counsel for the EPF authority has placed a copy of the ordersheet wherein it is noted that the petitioner herein did not raise any dispute/objection in respect of the report of inquiry

with dues and payment as filed and the hearing was concluded as there was no dispute.

Learned counsel for the petitioner submits that the petitioners being aggrieved with the order under challenge have preferred an appeal and pray that the appeal may be heard in due course and pray for interim protection.

On hearing the parties, the writ application is disposed of with the direction that the petitioner shall pursue the appeal preferred before the Tribunal.

Pending hearing of the appeal, the order under challenge dated 11th December, 2024 and the recovery notice dated 4th August, 2025 be stayed till disposal of the appeal.

Writ application stands disposed of.

Applications, if any, connected thereto stand disposed of consequently.

Interim order, if any, stands vacated.

11.

Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
