Petitioners are aggrieved by the fact that in spite of Purulia Town Police Station case no. 175/2025 having been registered on 04.05.2025 no steps have been taken by the police authorities. Petitioners are members of GEL Church, Purulia. Petitioners deny the locus of the private respondent nos. 5, 6 and 7 to accept any offerings/money and any transaction with regard to the Church. Learned advocate for the petitioners submit that in spite of a case having been registered under Sections 319(2)/318(4)/316(2)/3(5) of the BNS the police authorities have not progressed with the investigation of the case, consequently, there is no scope of unearthing the truth.

State has submitted a report. Report reflects that at the relevant period steps were taken immediately after the case was registered for investigation and notices have been sent to the de-facto complainant which till date has not been complied with.

I find from the notice under Section 94 of the BNSS which was issued to the informant Amaresh Kumar Dutta (Petitioner no.12), the details of documents which incorporated CCTV Footage at time of incidents; name of witnesses; transaction details; related documents and others.

Learned advocate for the respondent nos. 5, 6 and 7 denies and disputes such contentions and further submits that since no affidavits have been called for the accusations made in the writ petition are deem not to have been admitted.

Considering that a dispute is continuing between the members and others to claim themselves to be portfolio holders, I am of the opinion that a Superior Officer in the rank of SDPO/Additional SP will monitor the investigation of the case. In the meantime the informant/Petitioner no.12 is directed to comply with the notice which was earlier issued under Section 94 of the BNSS and/or further documents which are called for from the present investigating officer of the case.

With the aforesaid observations WPA 19505 of 2025 disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioners.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
