The Commissioner of Police, Barrackpore Police Commissionerate has filed a report date 18th January 2022 and the same is taken on record.
The Investigating Officer, Baranagar Police Station and the Investigating Officer, Barrackpore Women Police Station are present in Court.
It appears that several complaints have been registered as FIR by the Baranagar Police Station and Barrackpore Women Police Station respectively. The first of the complaints under Section 498A of the Indian Penal Code have been made only against the husband of the writ petitioner in the Barrackpore Women Police Station being Barrackpore Women Police Station Case No.36 of 2021 dated 26.07.2021.
The next complaint under Section 498A of the Indian Penal Code and 3/4 of the D.P. Act have been made against the husband of the writ petitioner and the in-laws with the Baranagar Police Station being Baranagar Police Station Case No.731 of 2021 dated 27.12.2021.
After returning from the work on the given day the writ petitioner found that her daughter namely Santoshi Kumari is also missing. A separate complaint has been registered under Section 363/365 of the Indian Penal Code in the Baranagar Police Station being Baranagar Police Station Case No.361 of 2021 dated 17.07.2021. It appears to this Court after perusal of the report of the Commissioner of Police, Barrackpore Police Commissionerate and the Case Diary that the investigations are on full swing. Two officers of the rank of Assistant Commissioner of Police namely Assistant Commissioner of Police-II, Detective Department, Barrackpore Police Commissionerate and Assistant Commissioner of Police, Belghoria, have been assigned to these cases for monitoring the investigations. It further appears that a joint team of the Baranagar Police Station and Barrackpore Women Police Station have deputed to Bihar where the in-laws are located. It is expected that urgent and expeditious steps be taken for enforcing the attendance of the accused in the investigation.
It is also expected that the investigation in Baranagar Police Station Case No.361 of 2021 dated 17.07.2021 be completed as expeditiously as possible and the missing girl be recovered.
The presence of the Investigating officers of Baranagar Police Station and Barrackpore Women Police
Station are noted and dispensed with and they may be returned back to their respective duties.
It is expected that the investigations of the cases be completed as expeditiously as possible preferably within a period of two months from date and final report be submitted before the jurisdictional Magistrate. The Court records satisfaction as regards the steps taken by the investigating officers in the course of investigation.
Case diary produced before this Court is returned. With the aforesaid observations, the writ petition is disposed of.
There shall be no order as to costs.
