Despite service, none appears for the private respondents, although the petitioner and the CESC Limited are represented through counsel.

Learned counsel for the petitioner contends that the petitioner, who is of advanced years, is being deprived of electricity at the premises, where the petitioner is residing, despite having made an application for new connection.

Learned counsel for the petitioner further contends that such connection is not being given apparently due to hindrance created by the private respondents.

However, learned counsel appearing for the CESC Limited submits that a specific allegation has

been made by the CESC Limited as regards the apprehended splitting of load in the event such new connection is given.

It appears from Annexure P-3 at page 26 of the present writ petition that the CESC Limited has specifically raised an objection as regards intention of the applicant of splitting the load to obtain the benefit of lower charges.

Since, under the extant Regulations, such a dispute has to be decided by the concerned Grievance Redressal Officer (GRO), WPA 20550 of 2021 is disposed of by granting the petitioner liberty to approach the concerned GRO with the issue of new connection. If so approached, the GRO shall, upon giving appropriate opportunity of hearing to all the interested parties, decide such matter as expeditiously as possible, preferably within four weeks from the date on which such application is made by the petitioner.

This Court has not gone into the merits of the respective contentions of the parties in respect of their right, title and interest.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
