Mr. Debasish Kundu ...............for the petitioner Ms. Smita Das De .......for the UOI By an order dated August 22, 2023, this Court directed the Superintendent, Eastern Command Hospital, Kolkata to have the "hemoglobin percentage" of the petitioners assessed and file a Report on the issue whether the petitioners could be considered to be fit for discharging the duties as Constable (GD).

From the Report of the President, Medical Board for Commandant it appears that both the petitioners are unfit since the "hemoglobin percentage" of the petitioners are not according to the parameters prescribed for medical fitness. Therefore, WPA 19434 of 2023 is dismissed.
