The petitioner seeks that the representation made on 17th August, to the Registrar, Kalyani University be considered. The representation is in relation to absorption of the petitioner as a permanent employee. Learned counsel appearing for the University places an order of the Registrar dated 14th September, 2015 by which the petitioner was directed to report for joining the University within one month of the order failing which the offer would stand cancelled. Counsel submits that the petitioner did not take the offer and has instead made a representation after six years to the University. It is also submitted that the University will not absorb the petitioner under the statute after the offer has lapsed.

Upon hearing learned counsel, this court is of the view that the contentions of the University or if the University changes its stand should be made known to the petitioner by way of passing a reasoned order upon considering the representation of the petitioner and all concerned parties in accordance with law. Needless to say, the Registrar of the University will consider the prayer for absorption against the available vacancy and in case the petitioner is found eligible then shall take steps without any delay.

W.P.A.20559 of 2021 is disposed of in terms of the above.

Affidavit of service is to be filed in course of today. Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
